Terms of Use for PrecondAI

1. Acceptance of Terms

By downloading and using PrecondAI ("the App"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use the App.

2. Description of Service

PrecondAI is a smart EV cabin preconditioning scheduler that calculates optimal climate start times based on weather conditions, battery level, and your departure schedule. The App connects to your vehicle through manufacturer-authorized APIs.

3. User Responsibilities

• You are responsible for maintaining the security of your vehicle API credentials
• You must not use the App in any way that violates your vehicle manufacturer's terms of service
• You acknowledge that preconditioning uses your vehicle's battery energy
• You are responsible for ensuring your vehicle is in a safe location for preconditioning

4. Subscription and Payments

PrecondAI offers auto-renewing subscriptions and a one-time purchase with the following terms:

Subscription Plans

• Monthly Plan: $2.99/month with 7-day free trial
• Yearly Plan: $19.99/year with 1-month free trial (save 44%)
• Lifetime Plan: $49.99 one-time purchase, no subscription needed

Free Trial Terms

• Monthly subscription: 7-day free trial, then $2.99/month
• Yearly subscription: 1-month free trial, then $19.99/year
• No charge during the free trial period
• Subscription automatically converts to paid at the end of the trial

Auto-Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• The subscription fee will be charged at the then-current rate

Cancellation

You can cancel your subscription anytime through your Apple ID settings:

1. Open the Settings app on your iPhone/iPad
2. Tap your name at the top
3. Tap "Subscriptions"
4. Find PrecondAI and tap "Cancel Subscription"

Refund Policy

All purchases are final. For refund requests, please contact Apple Support directly through your purchase history or visit reportaproblem.apple.com.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT:

• The App will function uninterrupted or error-free
• Preconditioning will always start at the calculated time
• Vehicle API services will remain available or unchanged
• Weather data will be 100% accurate
• Background task execution will always succeed (iOS controls background task scheduling)

6. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PRECEDING 12 MONTHS.

7. Vehicle API Dependency

The App relies on third-party vehicle manufacturer APIs (such as Tesla Fleet API and Smartcar). These APIs may change, become unavailable, or have rate limits that affect the App's functionality. We are not responsible for any changes or outages of these third-party services.

8. Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to discontinue the App or any feature at any time with reasonable notice.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the new Terms.
