Terms of Use

Welcome to Quench. By downloading and using the Quench app ("the App"), you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the App.

1. License to Use

We grant you a personal, non-exclusive, non-transferable license to use the App on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and Conditions.

2. Free Features

The core features of Quench — unlimited plants, daily digest reminders, the home screen widget, the species database, adaptive scheduling, and watering history — are free forever. No account is required.

3. In-App Purchases

Quench offers the following in-app purchases via Apple's App Store:

Quench Premium (Lifetime) — $3.99 USD: One-time purchase that permanently unlocks photo diary, weather integration, room management, custom notification time, data export, and theme selection.
AI Plant Doctor Monthly — $1.99 USD/month: Auto-renewable subscription that unlocks the AI Hub UI (identification, diagnosis, coach chat). Requires your own OpenAI API key.
AI Plant Doctor Yearly — $9.99 USD/year: Auto-renewable subscription (50% savings vs. monthly) with the same features as Monthly.
AI Plant Doctor Lifetime — $19.99 USD: One-time purchase that permanently unlocks the AI Hub UI. Requires your own OpenAI API key.

4. Auto-Renewable Subscription Terms

The AI Plant Doctor Monthly and Yearly subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

Payment is charged to your Apple ID account at confirmation of purchase.
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscriptions in your Apple ID settings at any time (Settings → Apple ID → Subscriptions).
Any unused portion of a free trial period is forfeited when you purchase a subscription.

5. Free Trial

The AI Monthly and AI Yearly subscriptions offer a 7-day free trial for new subscribers. The trial provides full AI Hub access (you must still configure your own OpenAI API key). The trial automatically converts to a paid subscription at the end of 7 days unless cancelled at least 24 hours before the trial ends. Cancelling during the trial incurs no charge.

6. BYO Key Model (AI Features)

AI features use a "Bring Your Own Key" model. This means:

You must provide your own OpenAI API key to use AI features.
Your OpenAI API usage is billed by OpenAI directly to your OpenAI account — Quench does not charge for AI generations and does not count or limit them.
The AI subscription or AI Lifetime purchase unlocks the AI Hub interface in Quench — it does not pay for your OpenAI API usage.
You are solely responsible for your OpenAI API usage and associated costs.
We are not affiliated with, endorsed by, or sponsored by OpenAI.

7. Restore Purchases

You can restore previous purchases at any time via the Paywall → Restore Purchases button. This is free and does not charge you again.

8. User Content

You retain all rights to the photos, notes, and data you create in the App. All user content is stored locally on your device. You are responsible for backing up your data using the Export Data feature (Premium).

9. Acceptable Use

You agree not to:

Reverse engineer, decompile, or disassemble the App.
Use the App for any unlawful purpose.
Attempt to bypass in-app purchase mechanisms.
Use the AI features to generate harmful, illegal, or abusive content.

10. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. Plant care advice, AI diagnoses, and watering schedules are for informational purposes only and are not a substitute for professional botanical advice. We do not guarantee that your plants will thrive or survive.

11. Limitation of Liability

To the maximum extent permitted by law, Quench and its developer shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to plant death, data loss, or OpenAI API charges incurred through your use of the App.

12. OpenAI API Liability

Since AI features use your own OpenAI API key, you are solely responsible for any charges, data usage, or content generated through your OpenAI account. We are not responsible for OpenAI's practices, pricing changes, or service availability.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws applicable in your jurisdiction of residence, without regard to conflict of law principles.
