📋 Agreement to Terms

By downloading, installing, or using MatchKeeper (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and MatchKeeper regarding your use of the App.

1 Description of Service

MatchKeeper is a mobile application designed to help users track and manage their dating app matches by:

• Creating countdown timers for match expiry times
• Sending reminder notifications before matches expire
• Organizing matches by platform and status
• Providing statistics about match activity (Premium/Pro features)

2 Eligibility

You must be at least 17 years old to use MatchKeeper. By using the App, you represent and warrant that:

• You are at least 17 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the App under applicable laws
• All information you provide is accurate and complete

3 User Accounts and Subscriptions

Free Version

MatchKeeper offers a free version with limited features. You may use the free version indefinitely subject to these Terms.

Paid Subscriptions

We offer several subscription tiers (Basic, Premium, and Pro) that provide additional features:

• All purchases are processed through Apple's App Store
• Subscription fees are charged to your Apple ID account
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel your subscription in your Apple ID account settings
• No refunds will be provided for partial subscription periods

Free Trials

Some subscriptions may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

4 User Responsibilities

You agree to use MatchKeeper only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable law or regulation
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the App or servers connected to the App
• Use the App to harass, abuse, or harm another person
• Reverse engineer, decompile, or disassemble any part of the App
• Remove any copyright, trademark, or other proprietary notices
• Transfer or sell your account to another person

5 Intellectual Property

MatchKeeper and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App on your personal iOS device. This license does not include:

• Modifying or copying the App
• Using the App for any commercial purpose
• Attempting to extract the source code of the App
• Creating derivative works based on the App

6 Third-Party Services

MatchKeeper may integrate with or reference third-party services, including dating platforms. You acknowledge that:

• We have no control over third-party services
• Your use of third-party services is subject to their respective terms and policies
• We are not responsible for the content, policies, or practices of third-party services
• Any interactions you have with dating platforms are solely between you and those platforms

7 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Merchantability, fitness for a particular purpose, and non-infringement
• That the App will be uninterrupted, timely, secure, or error-free
• That the results from using the App will be accurate or reliable
• That any errors in the App will be corrected

8 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any damages arising from missed matches or expired connections
• Any damages resulting from your reliance on the App's notifications

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

9 Indemnification

You agree to defend, indemnify, and hold harmless MatchKeeper and its operators from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the App
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property rights
• Any content you provide through the App

10 Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the App will immediately cease
• All provisions of these Terms which by their nature should survive termination shall survive
• You may delete the App from your device at any time to stop using the service

11 Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised terms.

12 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in California.

13 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

14 Entire Agreement

These Terms constitute the entire agreement between you and MatchKeeper regarding the App and supersede all prior agreements and understandings, whether written or oral.
