Terms of Use

1. Agreement to Terms

By downloading and using Giftly ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

2. License to Use

Giftly is provided as a free download. You are granted a personal, non-exclusive, non-transferable license to use the App on your Apple devices in accordance with these Terms and the Apple App Store Terms of Service.

3. In-App Purchases

Giftly offers the following one-time (non-consumable) In-App Purchases:

• Giftly Pro ($4.99 USD) — One-time purchase that unlocks premium features
• AI Add-on ($5.99 USD) — One-time purchase that unlocks AI gift suggestion features

Important:

• These are non-consumable purchases — you pay once and own them forever
• There are no subscriptions, no auto-renewal, and no trial periods
• Purchases are tied to your Apple ID and can be restored on any device using the same Apple ID
• All purchases are processed by Apple's StoreKit framework and subject to Apple's App Store terms
• Prices are in USD and may vary in other currencies based on Apple's App Store pricing tiers

To restore purchases: Settings → Upgrade → "Restore Purchases".

4. AI Feature — Apple Intelligence

The AI gift suggestion feature uses Apple Intelligence, which runs entirely on your device:

• AI suggestions are generated on-device using Apple's FoundationModels framework (iOS 26+)
• No account and no third-party AI provider are required
• No network request is made for AI suggestions — your data never leaves your device
• The free tier includes 3 AI suggestions per month
• The AI Add-on unlocks unlimited AI suggestions with a one-time purchase
• AI-generated suggestions are for inspiration only — use your judgment when selecting gifts

The AI Add-on purchase unlocks unlimited AI suggestions within the App. Apple Intelligence must be available on your device for AI features to function.

5. Privacy & Data

All data you enter in Giftly (people, birthdays, gift ideas, etc.) is stored locally on your device. We do not collect, transmit, or store your personal data on our servers. See our Privacy Policy for full details.

6. Acceptable Use

You agree to use Giftly only for lawful purposes. You agree not to:

• Use the App to store information about individuals without their consent (where required by law)
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App in any way that could damage, disable, or impair the App's functionality

7. Disclaimer of Warranties

The App is provided "AS IS" without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be error-free or uninterrupted
• AI-generated suggestions will be accurate, appropriate, or suitable for your needs
• Birthday notifications will always be delivered on time (notifications depend on your device settings and battery)

8. Limitation of Liability

To the maximum extent permitted by law, Giftly's developers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to missed birthdays, inappropriate gift suggestions, or data loss.

9. Data Backup

You are responsible for backing up your data. Giftly provides an Export feature (Settings → Export Backup). We are not responsible for data loss if you do not maintain backups and the App is deleted or your device is lost.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by applicable laws in your jurisdiction. Any disputes shall be resolved in accordance with Apple's App Store dispute resolution process where applicable.
