MoonShift Terms of Use

Welcome to MoonShift. By downloading, installing, or using this app, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the app.

1. License to Use

MoonShift grants you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. You may not:

• Modify, adapt, or reverse-engineer the app
• Distribute, sublicense, or resell the app
• Use the app for any illegal purpose

2. In-App Purchases

2.1 Subscription

MoonShift offers the following Pro subscription options:

• Monthly: $2.99 per month
• Yearly: $19.99 per year (7-day free trial available)
• Lifetime: $39.99 one-time payment

2.2 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple ID settings at any time.

2.3 Free Trial

The yearly subscription offers a 7-day free trial. If you do not cancel before the trial ends, your subscription will begin and your Apple ID will be charged.

2.4 Refunds

All purchases are processed by Apple. Refund requests must be directed to Apple Support at support.apple.com/billing.

3. Health Disclaimer

MoonShift is not a medical device and does not provide medical advice.

• The app provides general sleep planning recommendations based on shift work research
• Always consult a qualified healthcare professional before making medical decisions
• Do not use the app to diagnose, treat, cure, or prevent any medical condition
• If you have a sleep disorder or medical condition, consult your physician
• The recovery score is an estimate based on self-reported and HealthKit data, not a clinical assessment

4. User Responsibilities

You agree to:

• Provide accurate information when logging sleep and caffeine data
• Use the app only for its intended purpose
• Not rely solely on the app for safety-critical decisions (e.g., driving while fatigued)
• Follow all applicable laws and regulations

5. Privacy

Your use of the app is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

6. Intellectual Property

All content, features, and functionality of MoonShift—including but not limited to text, graphics, logos, algorithms, and software—are owned by MoonShift and protected by international copyright, trademark, and patent laws.

7. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The app will be uninterrupted, secure, or error-free
• Any errors or defects will be corrected
• The sleep recommendations will be suitable for your specific situation
• HealthKit data will be accurate or complete

8. Limitation of Liability

To the fullest extent permitted by law, MoonShift shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or profits
• Sleep-related accidents or injuries
• Workplace incidents resulting from fatigue
• Any damages arising from reliance on app recommendations

Your total liability for using the app is limited to the amount you paid for the app or subscription in the past 12 months.

9. Indemnification

You agree to indemnify and hold harmless MoonShift from any claims, damages, or expenses arising from your misuse of the app or violation of these Terms.

10. Termination

We may terminate or suspend your access to the app at any time, without notice, for violations of these Terms. Upon termination, your right to use the app ceases immediately.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which the developer resides, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
